Helena, Aug. 28.—Attorney General Albert J. Galen today rendered an opinion which will be of great interest to taxpayers and county treasurers throughout the state, relative to the time when taxes for 1905 become delinquent, and also as to which fiscal year taxes collected on December 1 should be credited. The opinion was rendered in response to a letter from County Treasurer G. F. Robbins, of Custer county, who was the first to notice that November 30, the last day permitted under the law for the collection of taxes, is a legal holiday.

The attorney general in his opinion quotes section 12 of the Political code, which stipulates that any secular act appointed by law or contract to be performed on a particular day, such act may be performed upon the next business day following with the same effect as though done upon the day prescribed.

Therefore, taxes will not become delinquent until 6 o'clock p. m. December 1, 1905, and consequently should be credited in the receipts of the fiscal year ending November 30, 1905.
